The decision is made under subparagraph j) of Article 122 of Law No. 23/2007, enacted in April 2007. However, the procedure applies only to those who have not left Portugal, as the agency announced on social media.

The application is made via an online form available at contactenos.aima.gov.pt. On the website, select, in the topic type “Residence Permit” and as a sub-type of subject: "Authorisation exempting from residence visa – Art 122 – subparagraph j)."

The agency also states that “all legally required documents” must be attached.

How to fill in the form?

On the official AIMA website, the agency states that citizens must provide their full name, email address, mobile phone number, date of birth, nationality, residence permit number and passport number.

The application will then be formalised with the addition of documents such as a scanned copy of the passport, a scanned copy of the Residence Permit, IRS declaration; a scanned copy of the employment or service contract and declaration of self-employment with the Tax Authority (AT); proof of registration with Social Security (NISS); proof of Social Security contributions; proof of accommodation (AT).
